THE DYNAMICS AND THE DEBATE
An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers
Published by Edward Elgar Publishing, this volume examines much of the latest research and thinking on what are described as the `twin pillars' of the continually developing and changing European Union: EU enlargement and EU reform -- also referred to as the `widening/deepening' debate.
The book is a compilation of learned articles from no less than a dozen leading academics from at least as many European universities, including two from the UK. The editors -- all from the University of Cologne - and contributors variously map, analyse, evaluate and generally explore the recent transformation of governance in the European Union.
As the editors explain in their introductory essay, the key question that informs this volume is: `what changes have taken place in EU governance and which factors can be identified that account for such change?' The changes in question of course are those which have followed largely in the wake of the Lisbon Treaty in December 2009 and the volume of over 250 pages contains the research of political scientists and economists as well as lawyers.
In keeping with the aims of Elgar's new `Studies in EU Reform and Enlargement' series, the book's conspicuously multi-disciplinary approach does much to explain -- if a trifle technically -- the dynamics of EU governance and offers a useful contribution to the on-going debate about the future direction of the EU - rather an important issue to those of us who live and work in any of the EU member states.
One of the more intriguing, not to mention puzzling chapters (to those not jurisprudentially inclined) is the one on `soft law as a new mode of governance.' `Soft law' is extensively and intensively defined here, with the tentative conclusion that it might be `an indicator of the strength and advanced stage of the (European) integration process'... and that `stable societies can afford soft rules.' Well, that's reassuring! Let's have more soft law by all means - the more the better, unless you happen to have ruthless dictatorial tendencies.
If you're a specialist in EU law, whether practitioner or academic lawyer, or possibly a graduate student, this book is a useful research tool, with any number of footnotes and bibliographies, not to mention a list of abbreviations and a detailed index. Published recently in 2011, the book is certainly a worthwhile source of current thinking and research on a broad spectrum of issues pertaining to EU governance and a great addition to the current European debate.
